ADMINISTRATIVE HEARINGS BOARD
The
City of Redding has enacted a newly established three-person Administrative
Hearings Board tasked with administrative enforcement of provisions of the
Redding Municipal Code (Code).
The membership of the board
shall include persons with professional experience in law, law enforcement,
dispute resolution, administrative processes, engineering, general contracting,
subcontracting or real estate, and must be a resident of the City of Redding,
own a business or be employed within the city limits of Redding.
Hearings will be held the third Wednesday of each month at 2:00 p.m. in the City Council Chambers, 777 Cypress Avenue, Redding, California. Appointed individuals will serve staggered
terms of two, three and four years, and
the duties of the Administrative Hearings Board will include:
- Conduct fair and impartial Administrative Hearings in accordance with the Redding Municipal Code and the administrative Rules of the Hearings Board;
- Receive testimony and accept evidence relevant to the allegation of a violation of the Redding Municipal Code;
- Issue subpoenas directing witnesses to appear and give relevant testimony at the hearings;
- Preserve and authenticate the record of the hearing, including all exhibits and evidence introduced at the hearing;
- Issue determinations, based on the evidence presented at the hearing, whether a code violation occurred or exists. The Hearings Board will make determinations in writing on findings of fact, issuing relevant decisions, including the fine, penalty or other actions necessary to ensure compliance with zoning, building, health and safety, and property blight ordinances.
- Impose penalties consistent with applicable Code provisions upon finding a defendant liable for the violation.
All
applications are reviewed by the Mayor, or designee, to determine if the
experience requirements are met. In the event that an applicant does not meet
one or more requirements, the City reserves the right to waive any particular
requirement if sufficient alternative experience and qualifications can be
demonstrated. The Mayor's recommendations for appointment will be referred to
the City Council for final selection. Inquiries regarding the duties or
