(1) USE PERMIT APPLICATION UP-13-07, by Vitalis Partners, requesting approval to construct a 200,000-square-foot retail/office commercial center on 27 acres located on the east side of Churn Creek Road between Arizona Street and South Bonnyview Road in an "SC" Shopping Center District. The project includes 130,000 square feet of box-type retail encompassed within three major tenant buildings; small inline retail stores; and freestanding retail, bank, office, and restaurant pads. Environmental Determination: Mitigated Negative Declaration. Staff Recommendation: Adoption of the Mitigated Negative Declaration and approval. Continued from the meeting of November 25, 2008. L-010-390 CONTINUED INDEFINITELY, WITH GOAL TO RETURN IN JANUARY 2009

(2) USE PERMIT APPLICATION UP-10-08, by Contech Construction Products, Inc., requesting approval to allow encroachment into a floodplain in order to construct a stormwater-treatment system on property located at 2245 Canyon Creek Road in a "GI" General Industry District. Environmental Determination: Categorically Exempt. Staff Recommendation: Approval. L-010-390  APPROVED

(3) USE PERMIT APPLICATION UP-10-05, by TFG Properties, Inc., requesting approval to construct a commercial and residential mixed-use project to include 7 buildings consisting of approximately 245,052 square feet of building area and a 124,243-square-foot, 4-level parking structure. Uses include a hotel; 19,674 square feet of office space; 45,301 square feet of retail space (including a restaurant, club, and liquor store); 72 multiple-family residential units (all 2-bedroom); and a parking structure. The use permit is also a request for encroachment into the 100-year floodplain of Sulphur Creek and includes a number of off-site improvements in order to facilitate the project. The site is located at 413 through 493 and 607 North Market Street and is zoned "GC-V/R-FP-BH" General Commercial-Visitor/Retail District with Floodplain and Building Height Overlay Districts. Environmental Determination: Mitigated Negative Declaration. Staff Recommendation: Adoption of the Mitigated Negative Declaration and approval. L-010-390 ADOPTED MITIGATED NEGATIVE DECLARATION AND APPROVED

 

(4) TENTATIVE SUBDIVISION MAP APPLICATION S-8-07, POPPY HILLS SUBDIVISION, AND VARIANCE APPLICATION V-3-05, by Thomason Development, requesting approval to divide 46 acres into 19 lots for development of single-family homes and two large lots for future subdivision or development on property located on Poppy Hills Drive between Twin View Boulevard and Hilton Head Drive in "RS-3" Residential Single Family, "RM-9" Residential Multiple Family, and "RM-15" Residential Multiple Family Districts and for establishment of lot setbacks from Churn Creek consistent with those existing in the Fairway Estates Subdivision. Environmental Determination: Mitigated Negative Declaration. Staff Recommendation: Adoption of the Mitigated Negative Declaration and approval. S-101-128  CONTINUED INDEFINITELY
